By purchasing products from Layered Living Collections or using our website, you and Layered Living Collections agree that any dispute, claim, or controversy arising out of or relating to your purchase, use of our website, these Terms of Service, or any products sold by us shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided below.

ARBITRATION PROCEDURE:

If the dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, unless both parties agree to a different arbitration provider. The arbitration shall be conducted by a single neutral arbitrator.  The arbitrator shall have the authority to award any relief available under applicable law.

GOVERNING LAW:

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles, except where Federal Arbitration Act, governs the enforceability of this arbitration provision.

CLASS ACTION WAIVER:

To the fullest extent permitted by law, you and Layered Living Collections agree that all claims shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class action, collective action, representative action, or consolidated proceeding.

SMALL CLAIMS COURT:

Nothing in this Agreement prevents either party from bringing an eligible individual claim in a small claims court with proper jurisdiction.

EXCEPTIONS:

This arbitration agreement does not prevent either party from seeking temporary or preliminary injunctive relief when necessary to protect intellectual property rights or confidential information.

SEVERABILITY:

If any portion of this arbitration provision is found to be unenforceable, the remaining portions shall remain in full force and effect to the maximum extent permitted by law.
